Part 1: The new electoral system?

????????????-The Election Day: 23 December B.E. 2550 (2007)?
????????????-The Royal Decree calling for an election has been effective since 25 October B.E. 2550 (2007)?

????????????There are 58 days for preparation of the election under the new constitution and electoral laws since the enforcement of the Royal Decree.?

????????????The new electoral system The House of Representatives consists of 480 members😕

????????????-1) 400 of whom are from the constituency based election?
????????????-2) 80 of whom are from the proportional based election?

????????????Constituency: There are totally 157 constituencies throughout the Kingdom of Thailand.?

-Any province having less than 3 MPs shall be regarded as a constituency.?
-Any province having more than 3 MPs shall be divided into a constituency but having not exceeding 3 MPs?
each.?

????????????Voting: There are 2 types of ballot papers and boxes.?

????????????The constituency based MP election: Any constituency having one MP, a voter shall have one vote. If more, a voter can cast his/her vote equal to the number of MPs each constituency has.?

????????????The proportional based MP election: A group of provinces shall be regarded as 1 constituency. There are 8 groups of provinces and each of them shall have 10 MPs. A voter shall cast a vote for a political party running for an election in his/her own group of provinces. The more votes a political party receives, the more seats a party shall have in the parliament.

Part 2: Qualification of a person involving in an election?????????????Qualification of an eligible voter Voting is compulsory and any person who fails to vote without notifying reasonable cause of such failure will lose the following rights:--Right to object the MP election and Senatorial selection;?
-Right to apply for candidacy of the national and local elections and to be nominated for the Senatorial?
selection;?
-Right to apply for a sub district headman and village headman.?

????????????Such rights are given back to a voter when he/she votes in the next election at whatever level.?

????????????Prohibitions of being an eligible voter
?
????????????-being Buddhist priest, novice, monk, or clergy?
????????????-being under suspension of the right to vote?
????????????-being detained by a warrant of the court or by a lawful order?
????????????-being of unsound mind or of mental infirmity?

????????????Qualification of an eligible voter?-Thai nationality; a person who has acquired Thai Nationality by naturalization shall hold Thai nationality for
not less than 5 years;?
-Not less than 18 years on 1 st January 2007?
-Having name appeared on the house register in the constituency for not less than 90 days up to the date of
the election

Part 3: Electoral administration?

????????????Electoral Management Body -According to the 2007 Constitution, the Election Commission of Thailand has powers and duties to organize an election to be proceeded in an honest, free, and fair manner. The Election Commission consists of 5 persons of apparent integrity and impartiality. The Election Commission shall appoint the Provincial Election Commission of each province.

-There are 45 minion eligible votes.??
-There are 2,396 ECT staff.
-There are 88,500 polling stations and each of them accommodating about 800 eligible voters.?

????????????In practice, the Election Commission shall appoint the election committee, director, sub-committee of a constituency including committee and director of a polling station. Each polling station shall have at least 9 committees.?

????????????Moreover, the Election Commission has received collaboration from electoral supporting agencies; for example,?
????????????-Ministry of Interior?
????????????-Ministry of Foreign Affairs?
????????????-Ministry of Education?
????????????-Royal Thai Police
????????????-Thailand Post Company?
????????????-Electricity Authority?
????????????-T.O.T. Company?
????????????-Local Administration Organization?
????????????-Department of Public Relations

Part 4: Election campaign?

????????????According to the 2007 Constitution and the electoral law, the Election Commission shall determine the rules and procedures of the State in supporting an election. This is the first time in Thailand that a clear guidance for displaying campaign posters or billboards and campaigning through radio and television is prescribed.?

????????????1. The size and place for displaying posters and billboards shall be in compliance with the rule and regulation as prescribed by the Election Commission.?
????????????-Size of poster
????????????????????????: A3 Number?
????????????????????????: Only one poster shall be displayed for each place.?
????????????-Size of billboard?
????????????????????????: 130×245 cm2 Number?
????????????????????????: The number of billboards shall not exceed 5 times of the number of polling stations in each
????????????????????????? constituency.?
????????????-Place for displaying
????????????????????????: Posters and billboards shall not be displayed in private places.?
????????????????????????:State places; government sector, state enterprise, or local administration organization shall issue
?????????????????????????rule and regulation for using.?

????????????A candidate or political party shall notify the requirement to the head of agency. Consideration of the relevant agencies is based on equality and sufficiency.?

????????????2. Campaigning through radio and television?

-Short spot: A station shall allocate the airtime for each political party at least 3 times a day and not
exceeding 30 seconds for each political party.
– Policy of political party: A station shall allocate the airtime for each political party at least 3 times a day and?
not exceeding 10 minutes for each political party.
-A station may invite a political party to express its vision, or to discuss on policy, or to answer questions;
however, every political party shall have an equal opportunity.?
-No person shall campaign whether directly or indirectly to favourable any candidate or political party in any?
program of station.
-The Office of the Provincial Election Commission shall arrange at least 1 central stage for a candidate or
political party of every district. The use of this central stage shall be allocated for a candidate or political party equally.?

????????????A candidate or political party shall ask permission from the government sector, state enterprise, or local administration organization to use a place for campaigning but shall be responsible for the costs.

Part 5: Pre-poll voting?

????????????1. Over-sea Voting?
-For a voter residing abroad?
????????????2. Voting outside a province?
-For a voter residing outside his/her own province in which his/her name appeared in the household
register?
????????????3. Voting in a constituency?
-For a voter receiving an order to work in the area outside his/her constituency or being unable to vote
on the election day at his/her polling station.
-Voting outside a province Voting at the central Voting in a constituency polling station?

????????????For the pre-poll voting, a voter shall enrol between 22 October -22 November 2007. The dates for the pre-poll voting are 15 -16 December 2007. The Election Commission will bring all the pre-poll voting ballot papers to count on the election day.

Part 6: Electoral irregularities?

????????????1. Electoral Frauds Giver: to induce voter to vote for/ abstain from voting for any candidate or political party by: -?

– providing, giving, offering, promising to give or preparing to give properties or any other benefits calculated
in money value?
– campaigning for an election by organizing an entertainment or other fair?
– organizing festivity or promising to treat any person?
-cheating, compelling, treating, using influence to slandering or including the misunderstanding in popular
vote of any candidate or political party.?

????????????Penalties: Imprisonment for 1-10 years/ or 20,000-200,000 Baht in fines/ including revocation of voting right for 10 years by the court’s order?

????????????Receiver: asking to receive, or receive properties or other benefits for voting for/ abstaining from voting for any candidate or political party?

????????????Penalties: Imprisonment for 1-5 years/ or 20,000-100,000 Baht in fines/ or to both/ including revocation of voting right for 5 years by the court’s order?

????????????However, if a receiver declares to the Election Commission of such manner or within 7 days as from the date of election, such a person shall be exempt from punishment including revocation of voting right.?

????????????2. Destroy a ballot Paper?

????????????A person intending to destroy a ballot paper will be imprisoned for not exceeding 1 year/ or not exceeding 20,000 Baht in fines/ including revocation of voting right for 5 years by the court’s order.?

????????????3. Move or consent to move a person into household register in order to benefit an election
????????????? illegally
.
-Move 10 persons into a household register whose last names are not the same as an owner’s of the house
?in order to receive voting right within 2 years.?
-Move only name into a household register but not actually living.?
-Move into a household register without consent of an owner of the house.?

????????????Penalties: Imprisonment for not exceeding 2 years/ or not exceeding 40,000 Baht in fines/ or to both?

????????????4. Arrange a vehicle for voters to go to a polling place or from a polling place without any fee or expenditure in order to induce or influence voters to vote for any candidate or political party.?

????????????Penalties: Imprisonment for 1-5 years! or 20,000-100,000 Baht in fines! or to both/ including revocation of voting right for 5 years by the court’s Order.?

????????????5. Sell. distribute. or host alcohol drinks in a constituency as from 6 PM of a day prior to an election until the end of the election day.?

????????????Penalties: Imprisonment for not exceeding 6 months! or not exceeding 10,000 Baht in fines/ or to both?

????????????6. Gamble on the election result?

????????????Penalties: Imprisonment for 1-5 years/ or 20,000-100,000 Baht in fines/ or to both! including revocation of voting right for 5 year by the court’s order

Part 7: Electoral roll?

????????????To Add or Withdraw name from the electoral roll?

????????????1. In the case where the name of an eligible voter does not appear in the electoral roll, a voter or owner of the house can request the election committee of a constituency or other person authorized by the Election Commission to add that name in the electoral roll within 10 days before the election day.?
????????????2. In the case where the name in the electoral roll is not an eligible voter, a voter or owner of the house can request the election committee of a constituency or other person authorized by the Election Commission to withdraw that name from the electoral roll within 10 days before the election day.?

????????????Evidence to produce: household register

Part 8: Polling?
????????????1. A period of voting 8 AM -3 PM?
????????????2. Identification?
????????????? ID card?
????????????? Expired ID card?
????????????? Other official evidences with photo and ID number of a card holder?

????????????3. Voting
-Mark a cross on the provided blank.?
-If a voter would not like to vote for any candidate or political party, he/she shall mark a cross on “No Vote”
blank.?

????????????4. Counting of Votes: At a polling station
