Canada, the 19th of October 2010: Kyle Anthony Brooks [18], was sentenced to two years in prison after pleading guilty to robbery on Tuesday in a provincial court.

“This is something more than many of the street robberies that come before the court,” said Judge Robert Philip, noting the June 6 robbery was a group attack against two people who were “simply minding their own business” and was something that ended with “tragic” results.

The court heard how Apichat Sudsaneh [37] was killed after rushing to the aid of two fellow Thai nationals and friends who were being attacked by a group of young thugs.

According to the agreed facts, Brooks had been hanging out with friends, four men and three women, eating pizza that they had stolen from a nearby pizzeria earlier, when Somjai Jansanga [34] and Somkiat Niyom [32] walked by their group.

The two Thai nationals, part of a group of welders legally working in the Canadian city of Edmonton, where returning to their nearby residence to farewell their friend Sudsaneh who was shortly returning to Thailand for a holiday.

As the pair walked by the group, including Brooks, the four youths decided to surround and rob the Thai men, who reportedly “looked scared” and tried not to provoke the group. One of the group left, before the three remaining men attacked the two Thai men, who attempted to flee the scene.

Niyom was caught by the offenders and was given a beating, while Jansanga returned to their residence to get help, returning with three other friends, including Sudsaneh. At this point, the Thai men overpowered their attackers, although Sudsaneh, in an altercation with one of the attackers, was stabbed and later died.

A joint submission has been accepted by the court for a three-year sentence reduced by a year after and early guilty plea by Brooks. He was also given four months credit for time spent in pre-trial custody, leaving him 20-months to serve.

Also involved in the incident were, Michael John Stewart [21], charged with second-degree murder, robbery and possession of a weapon and Bodan Allan Henry [18], charged with robbery and assault. Both men are to appear at court on Friday.
