Syrian Sentenced To 9 Years For Kiwi’s Murder

A Syrian ex-commando was sentenced to 9 years in prison for the August 2011 murder of a 56-year-old New Zealand man at a Jomtien condo. The Syrian, 22 at the time, admitted to performing oral sex for money. But when the Kiwi tried to sodomize him, the Syrian stabbed him to death.

PATTAYA – March 14, 2013 [Pattaya Daily News]; at 1:30 p.m. at Pattaya provincial court, the sentencing was read for a Syrian murder defendant, Mr. Mohammad Chanar Aryad. He was sentenced to a total of 9 years and 5 months in prison. Because Mr. Mohammad had confessed to his crime, the original prison sentence was reduced by half.

The suspect had confessed to stabbing the victim, Mr. Charles Edmund Jones, age 56, who was visiting Thailand on holiday. The murder attracted attention because of its sensationalist aspects, and because Mr. Charles was the president of the Kiwi World Croquet Federation.

As the court read the judgment, the defendant Mr. Mohammad Chanar Aryad listened to the verdict with no expression on his face. The officer of Pattaya prison then came to pick up him to serve his sentence. The defendant was a former commando of Syria, and had travelled to Thailand in the status of refugee of the United Nations, because there had been a war at his home town.

During the announcing of the sentence, the court summarized the violations committed in the case. The defendant had used a knife to stab the victim repeatedly, resulting in 27 wounds. Some wounds penetrated deeply inside organs such as heart, lung, liver, kidney and intestine until they were torn, which caused the victim’s death.

After the murder was discovered, the suspect was tracked down and arrested several days later on August 26, 2011. Police seized items from the suspect that had belonged to the victim.

They included a Nokia mobile phone worth 5,000 THB; a Sony notebook computer worth 20,000 THB; and a Rico brand wrist watch brand worth10,000 THB. The total value of the stolen items was about 35,000 THB. Police also seized a folding knife with a length of approximately 25 cm. in the room of the defendant.

Therefore, the court judged that the defendant had committed the faults as charged according to the criminal law act 288, 69,335, 371 and the act of immigrant year 1979, act 11, 62 and 81. The crimes committed by the defendant consisted of several different actions and had to be punished separately according to each action.

According to the criminal law act 91 of being the foreigner travelling into the Kingdom without permission, the punishment was to be in jail for 4 months; and for the fault of being a foreigner who stayed in the Kingdom without permission, the punishment was to be in jail for 6 months; and for stealing properties at night, the punishment was to be in jail for 4 years; and for taking a weapon to a town, village or public place without necessary cause, the fine was100 THB; and for killing other another person without the proper cause, the punishment was to be in jail for 14 years.

But since the defendant confessed in all accusations, this was useful for the consideration, so the court judged to reduce the punishment by half, with the defendant to serve a total time in jail of 9 years 5 months, and a fine of 50 THB.

Reading the verdict and the sentencing was Mr. Arthit Phanajan, the magistrate who is the deputy of the head of Pattaya provincial court, who together with the committee read the judgment of the case of the black number at 9931/2554, and the case of the red number at 2395/2555.

Also at the sentencing was was the attorney of the Office of the State Attorney of Pattaya province, as the plaintiff to prosecute Mr. Mohammad Chanar Aryad, the defendant, in the case of fault for the taking of a life and stealing properties, and the fault regarding the immigrant act (light penalty).
