Officials Enforce New Traffic Law To Prosecute Drunk Driver

Officials enforced the new law that the officer could prosecute any driver who refuses to take a Breathalyser test.

BANGKOK – December 31, 2014 [Pattaya Daily News]; a Traffic Controlling Facebook page announced the new traffic law that a person who refuses to take a breath test will be prosecuted on a charge of driving whilst under the influence of alcohol.

 

The law added 2 more regulations which consisted of 1.the officers could stop any car in an  inappropriate condition 2.the officers could prosecute any person who refuses to take a breath test

 

In addition the officers could ask the driver to stop the car and perform an alcohol test on them. Officer can ask the drivers to do a balance test. If they don’t conform to the officers requests then the officers could assume that the person is drunk and they could prosecute them on a charge of driving whilst under the influence of alcohol.

 

According to the former law, the person who refuses to perform the test will be fined up to 1,000 baht. While people that are tested and fail the test will be jailed for up to 1 year and will be fined 5,000-10,000 baht or both. Meanwhile, the person who refuses the officers to perform the test will be jailed for 1 year and will be fined 10,000-20,000 baht or both.

 

The reason that the official has to add a more severe punishment is because those drivers that always reject the officer when asked to perform the test are normally intoxicated and also drive their vehicle in a recklessness manner.
