On 9 August 2007, at 1 AM, Police Colonel Ithiphol Ithisarnronachai, Pattaya Immigration Superintendent, Chonburi, received a phone call from Mr. Samart (Alias), the owner of Rainbow House Apartment, on South Pattaya Road, Moo 10, Nongprue, Banglamung, Chonburi, that a tourist had taken a young boy to room 107, presumably to abuse him sexually. Police Major Thanaphat Promsuk, Immigration Inspector, was instructed by Police Colonel Ithiphol to investigate.
Police Colonel Thanaphat, with a police team, met with Mr. Samart (Alias) and immediately proceeded to Room 107, where the tourist had taken the young boy. Police knocked on the door and had to wait for about twenty minutes until the door was opened. The tourist who occupied the room was identified as Mr. Luc Bernard Nichel (56), a French citizen. He answered the door with a pale face and did not seem pleased to see the police. Police requested to look inside the room and found a fourteen year-old boy, Mr. Lit (Alias), naked on the bed and looking exhausted. Police asked him to put on his clothes before proceeding further.

The young man, “Lit”, said that he had been walking around Sunee Plaza, South Pattaya, and met Mr. Nichel, who asked him to come to his room for sexual activities. Mr. Nichel promised to give him 600 baht in exchange for sex. After “Lit” gave his account of what transpired, Mr. Nichel confessed that he propositioned the young man, “Lit”, and took him to his room for sexual activity. He is attracted to young boys and usually takes young men between fifteen and twenty years old to his room for sex. Police arrested Mr. Nichel and will process the case according to the law.
