Daughter of Kamnan Paou fined 15 million THB for not bringing her father to court

The court ordered that she be fined 15 million THB as she was the guarantor and didn’t bring her father to listen to the judgement of the Supreme Court in the case of hiring others to kill “Kamnan Yoon”

November 29, 2011 [Pattaya Daily News]; Att 9:30 a.m. the court had made an appointment to read the judgement in the case of hiring others to kill. Tthe complainant sued Mr. Somchai Khunpleum or ‘kamnan Paou’ age 73, ex-Lord Mayor Tambon Saensuk, Amphur Muang, Chonburi province and Mr. Passakorn Homhual age 44 the member of Saensuk Community, together the defendants 1 & 2 in the case of hiring others to kill with pre-meditation The court said that on July 8, 2003, during October 2002-March 9, 2003, the defendants together hired Mr. Thanavuth or ‘Ti Kerdkiertkul’ with others to kill Mr. Prayoon Sitthichot or’ kamnan Yoon’, kamnan of Tambon Samed, Amphur Muang, Chonburi province with pre-determination at a cost of 3 million THB. Mr. Thanavuth and others had planned to kill Mr. Prayoon many times but were not successful until on March 9, 2003, Mr. Prayoon was shot dead but Police could not find the gunman. Later, on April 17 and 24, 2003, the defendants surrendered to the investigating officer.

The Criminal Court had made the judgement on June 21, 2004, to imprison the 2 defendants for 25 years on each count the fault of the 1st defendant continuing from the red case at 843/48 of Chonburi provincial court of cheating to buy public land Tambon Khao Mai Kaew, Chonburi province to build a pond to dispose off garbage, they should be imprisoned for 5 years & 4 months more, a total of 30 years & 4 months.

Later, the 2 defendants went to the appeal court claiming that they didn’t do anything wrong and did not have anything to do with the dead body and the gunman was beaten and forced to blame the 1st defendant by Pol. Maj. Gen. Panupong Singhara na ayudhaya, Deputy Commissioner (at that time) as he wanted to be famous and be appointed Commissioner, when on October 12, 2005 the appeal court made the judgement to wait and let the 2 defendants submit their appeals.

Ms. Jiraporn Khunpleum, the daughter and guarantor of Mr. Somchai, the 1st defendant, had submited doctors reports from Phayathai hospital during February 22- March 21, 2006 – in total there were 4 certificates stating that the defendant was suffering from emphysema and a constricted blood vessel, the doctor ordered rest and therefore Mr. Somchai could not come to court and he asked for a postponement.

Mrs. Bangorn Homhual, the guarantor and the wife of Mr. Passakorn, the 2nd defendant, also submitted a petition with a government document that commanded Mr. Passakorn, a member of Tambon Saensuk Community, to assist flood victims at Pathumthani province during November 25-December 1, 2011 so he also could not come to court.

The court was of the opinion that in the case of Mr. Somchai, the 1st defendant, the doctors 4 certificates in 2006 had no report on having severe ymptoms, and was clearly not sufficient evidence, the guarantor had to bring the 1st defendant to listen to the judgement at the courts appointment, but when the guarantor didn’t bring the 1st defendant to court, the court ordered her to be fined the full amount.

In the case of the 2nd defendant, having a government notice of Tambon Saensuk Community dated November 24, 2011, it is believable that the 2nd defendant could not come to court, and agreed to postpone the listening of the judgement of the Supreme Court on January 24, 2012 at 9:00 a.m.

Ms. Jiraporn had submitted a petition concerning the guarantee of bonds, cash and title deeds worth 15 million THB to be temporarily released to Mr. Somchai. In addition, on April 7, 2006, Chonburi provincial court had made an appointment for Mr.Somchai to listen to the judgement of the Supreme Court concerning the case of buying public land to build a garbage pond at Tambon Khao Mai Kaew, Amphur Muang, Chonburi province in the amount of 140 rais, for the price of 93.52 million THB, the appeal court made a judgement to imprison Mr. Somchai for 5 years & 4 months but Mr. Somchai didn’t come to court, so the Chonburi provincial court believes that Mr.Somchai is trying to escape and issued an arrest warrant and fined the guarantor.
